Is incorporation of Catholic entities legal under Canon law?

The simple answer is yes, but with specific qualifications. As we explore this topic we will learn how easily what appears to be a simple protection becomes nefarious scheme to pillage treasure from gullible Traditional Catholics.

Catholic Church Corporations

What are they?

Corporations existed as an entity in the Roman Empire prior to the time of Our Lord, Jesus Christ. Early Catholics used these corporate structures as a means to protect temporal property for the support of the Church during times of persecution. These entities continue into our modern time only modified by the statutes of the country in which the Church property lies.

How are they formed?

There are two distinct points to consider in answering this question. 1) Corporations benefiting the Catholic Church are formed in accordance with the statutes of the country/jurisdiction in which it is formed and operates. 2) It must be previously approved by the legitimate ordinary and ultimately fall under his authority and control.

To what property will this apply?

This type of structure applies to any and all property of the Catholic Church. The parish church you attend, a convent or retreat house, the Cathedral in which the Archbishop offers Mass, and ultimately St. Peter's Basilica in Rome. In most jurisdictions this will also regulate the fiduciary elements as well ensuring the property is cared for and fund are auditable.

What is the corporate sole?

The spelling of this word is important. We are not talking about "soul" as in the unique spirit imparted by Almighty God at our conception and which he recalls for judgement at or death. The spelling "sole" is not the fish. We are referring to the individual who assumes the office which has authority over an entity or property. Common Law would suggest, "  the bishop, the vicar, or the pastor, who succeeds to the rights of an office and by consequence to the sole custody of its temporalities."

Why is the corporate sole important?

Only those with legitimate authority in a recognized office can assume the sole. Illegitimate claimants do not have any authority and cannot use the name Catholic or incorporate in the name of the Church. Those that do so are committing a fraud.
